SHIBUIMARKETS.COM IS A SERVICE ("SHIBUI", "SHIBUIMARKETS.COM, "SHIBUI SERVICE") OF Shibui Fixed Income Inc , (SFI). BY SELECTING THE CHECKBOX WHICH STATES "I have read, understand, and agree to the Terms and Conditions", OR BY USING THE SHIBUIMARKETS.COM WEBSITE ("Website"), YOU REPRESENT THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. These terms apply to your use of Shibuimarkets.com and all Shibui content independently of the delivery platform that you utilize. Shibui may change the terms and conditions of this Agreement at any time. Any changes will be published on this page. It is suggested that you regularly check these terms and conditions to see if there have been any changes. Using the Website after any such changes bounds you to the Agreement as changed.
SUBSCRIPTIONS:
Some areas of Shibuimarkets.com are only accessible to users who pay a subscription fee to SFI. Once you complete the subscription process and your payment has been received, you will have access to the parts of Shibuimarkets.com that you subscribed to. By subscribing to any one of these services you are agreeing to pay all subscription fees at the rates in effect when the charges are incurred. Your subscription charges are effective immediately on the day you subscribe and your credit card will be charged immediately. Recurring charges will take place on a regular basis (quarterly or , annually) unless service is cancelled.
Subscriptions may be changed or cancelled at any time and such changes will be effective at the end of the billing cycle following the request for downgrade or cancellation. Cancellation of product subscriptions have to be submitted no later than 24 hours prior to the end of the billing cycle in order to be effective for the next billing cycle. For example, downgrades or cancellations of an annual subscription will take effect from the end of the year in which you cancel. Cancellation or downgrade of a quarterly subscription will take effect at the end of the quarter in which you have cancelled. Service will continue until the end of the billing cycle.
UNDER NO CONDITIONS WILL CREDITS BE ISSUED FOR DOWNGRADES OR CANCELLATIONS THAT OCCUR BEFORE THE CURRENT BILLING CYCLE EXPIRES.
You must provide us with complete and accurate payment information. You can pay by either credit card, debit card, check or wire transfer. In the case of unauthorized payments Shibui reserves the right to suspend or terminate your access to the subscription services. If we payment authorization is not received or is cancelled, we reserve the right to suspend or terminate your subscription.
Shibui does not guarantee that the service that you subscribed for will be available to you at a specific time but will make a best effort to provide you with the subscription service as soon as your payment has cleared. Should you breach any of these Terms and Conditions, Shibui may, at its own discretion, suspend or terminate the service to you without notice and without further obligation to you.
RESTRICTION ON USE:
You cannot use Shibuimarkets.com for any unlawful purpose. Without written permission you cannot broadcast (or otherwise transmit), copy, publish, or create derivative works of the Shibui content. By accessing the Website, a user agrees not to redistribute the information found therein. You acknowledge that "ShibuiMarkets" is a registered trade mark and that you may not use it without written permission from SFI.
OWNERSHIP AND COPYRIGHT:
This Website and the information contained in it are owned by SFI. and/or its third party content providers ("Content Providers"). As such they are protected by U.S. and international copyright laws. SFI has the right to discontinue providing any portion or all of the Website or to restrict your access to it. SFI shall be under no obligation to correct any errors or omissions on the Website.
DISCLAIMER and LIMITED WARRANTY:

YOU ALSO AGREE THAT, TO THE FULL EXTENT ALLOWED BY APPLICABLE LAW, SFISHIBUI, ITS AFFILIATES AND ITS CONTENT PROVIDERS WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL OR EXEMPLARY DAMAGES WHATSOEVER THAT ARISE OUT OF OR ARE RELATED TO YOUR USE OF SHIBUIMARKETS.COM OR THE SHIBUI CONTENT.
YOU AGREE THAT THE ONLY REMEDY ARISING OUT OF YOUR USE OF A SHIBUIMARKETS.COM SUBSCRIPTION SERVICE IS LIMITED TO THE DIRECT DAMAGES YOU ACTUALLY INCUR ARISING FROM YOUR USE OF SHIBUIMARKETS.COM OR OF THE SHIBUI CONTENT SUBJECT TO A LIMIT EQUAL TO THE SUBSCRIPTION FEE THAT YOU PAID TO SFI PURSUANT TO THESE TERMS AND CONDITIONS DURING THE BILLING PERIOD IN WHICH THE DAMAGE OCCURRED.
The above disclaimers and restrictions on liability apply equally to your use of Shibuimarkets.com and all Shibui content.
INDEMNIFICATION:
By clicking "I Agree" at the end of this Agreement you are agreeing to indemnify, and hold harmless SFI., its affiliates and its Content Providers from all claims, liabilities, losses, costs and/or damages of any kind arising from or relating to your use of the website and/or your breach of this Agreement. WARNING: We strongly suggest that you exercise caution when reading and/or writing on the discussion forums. No Information posted to message boards should be relied on to trade or make investment decisions. Do not believe everything that you read on the discussion forums.
People are not always who they say they are. SFI and Shibuimarkets.com do not assume responsibility for any portion of any information posted on the discussion forums, nor are we responsible in any way for any trading or investment decisions that may result from information derived, directly or indirectly, from the discussion forums.
We reserve the right to remove any content and/or terminate an account at our own discretion.
PRIVACY:
We will make every reasonable effort to maintain the privacy of our user data. We may provide personal information, including IP addresses to comply with subpoenas and other legal obligations.

GOVERNING LAW AND JURISDICTION:
This Agreement is governed by and construed in accordance with the laws of the United States. To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of the United States has exclusive jurisdiction to settle any dispute which may arise in connection with these terms and conditions.
GENERAL:
You may not assign, or otherwise transfer any of your rights under these terms and conditions. If any provision of these terms and conditions is found to be invalid by a court with jurisdiction, the remaining provisions of these terms and conditions shall remain in full force and effect.
